CLEVELAND – Cuyahoga County Prosecutor Michael C. O’Malley announced that a Cuyahoga County grand jury has returned an indictment charging 69-year-old Edward Biesiada with Aggravated Murder among other charges for shooting and killing 52-year-old David Smerek in North Royalton.

This brazen act of violence will not go unanswered. We will do everything in our power to seek justice for Mr. Smerek, his family, and the North Royalton community.”

On July 24, 2026, around 1:22 p.m., Edward Biesiada drove to the North Royalton Service Center and parked his vehicle in the parking lot. He then entered the building with a firearm, approached David Smerek, and shot him multiple times.

After, Biesiada put the firearm on the counter and walked outside to the front of the building. The North Royalton Police Department and the North Royalton Fire Department responded, and David was pronounced deceased at the scene. Biesiada was immediately arrested.

On August 7, 2026, Edward Biesiada was indicted on the following charges:

  • One count of Aggravated Murder
  • Two counts of Murder (A & B)
  • Two counts of Felonious Assault
  • One count of Intimidation

He will be arraigned at the Cuyahoga County Justice Center at a later date.
